Environmental Permitting

The Environmental Protection (Miscellaneous Amendments) (England and Wales) Regulations 2018 (SI 2018 No. 1227) make amendments to the Environmental Protection Act 1990 (c. 43) and the Environmental Permitting (England and Wales) Regulations 2016 (SI 2016 No. 1154) with reference to environmental permits authorising certain waste operations; flood risk activities; and radioactive substances activities.

Conservation of Habitats and Species

The Conservation of Habitats and Species and Planning (Various Amendments) (England and Wales) Regulations 2018 (SI 2018 No. 1307) amend the Conservation of Habitats and Species Regulations 2017, the Neighbourhood Planning (General) Regulations 2012, the Town and Country Planning (Permission in Principle) Order 2017 and the Town and Country Planning (Brownfield Land Register) Regulations 2017. These Regulations transpose Article 6(3) of the Habitats Directive (i.e. Directive 92/43/EEC). Regulation 2 amends the Conservation of Habitats and Species Regulations 2017 (“Habitats Regulations“) applicable to special development orders, local development orders, neighbourhood development orders, simplified planning zones, enterprise zones and the conversion of footpaths into cycle tracks to incorporate the habitats assessments provisions in regulation 63 of the Habitats Regulations.

Energy Efficiency Scheme

The CRC Energy Efficiency Scheme (Amendment) (EU Exit) Regulations 2018 (SI 2018 No. 1336) are made in exercise of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies. These Regulations make amendments to legislation relating to the CRC Energy Efficiency Scheme in the CRC Energy Efficiency Scheme Order 2013 (SI 2013 No. 1119) and provide for the continuation after exit day of exemptions applicable immediately before exit day.
