The Environmental Permitting (England and Wales) (Amendment) (No. 2) Regulations 2013 implement EU Directive 2011/97/EU, which amends Directive 1999/31/EC on the landfill of waste with regards storing waste mercury.

Regulation 2(2) amends the Environmental Permitting (England and Wales) Regulations 2010 to replace the definition of the Landfill Directive and applies only in England and Wales.

Regulation 3, meanwhile, amends the Control of Major Accident Hazards Regulations 1999 (COMAH) and applies across England, Wales and Scotland, bringing sites used for the storage of metallic mercury within the scope of the COMAH Regulations.
