IEMA responds to Defra consultation

The government has recently consulted on establishing a process for environmental review, which is likely to be similar to the way in which judicial review currently works.

The consultation was undertaken by Defra during the summer, and IEMA put forward a submission setting out how establishing environmental review will require careful amendment of the Civil Procedure Rules. Specifically, our response recommended that there should be provision for all interested parties to have a role in environmental review, and that there is scope for the same provision on costs that is applied in judicial review, so that winning parties are awarded costs.
