The Water Environment (Remedial Measures) (Scotland) Regulations 2016 provide for the Scottish Environment Agency (SEPA) to serve a remedial measures notice on an “appropriate person”. This notice will require that person to undertake specified remedial measures. Before the remedial notice is served, SEPA must carry out a consultation with the "appropriate person" and any other person whom is likely to be substantially affected by the notice.
